APCS has observed an increase in the use of imbalance energy by pure trading balance groups. It can be assumed that imbalance energy resources, that are basically dedicated to mitigate forecast deviations, are also used by the market participants as mentioned above for other business models or intra-day transactions. This procedure is clearly in contradiction to European legal requirements as stated in detail below.

Therefore it was decided to amend the general terms and conditions of APCS in order to avoid wrongful usage of imbalance energy caused by pure trade balance groups. Imbalance energy for pure trading balance groups should only be allowed if their balance group deviations serve to reduce system imbalances.

In the case of observed imbalance energy in trade balance groups, which do not help the power system to be balanced, APCS will warn the balance responsible party and in case of recurrence terminate the contract with the balance responsible party (see text in the AB-BKO below).

(Legal) The basis for the obligation to maintain balance within the balance group is the 

  • Guideline on Electricity Balancing Article 17 (1) from 2017, which provides for the following balance sheets:

" In real time, each balance responsible party shall strive to be balanced or help the power system to be balanced...”

  • the electricity market code, which determines the balance within the balance group in Chapter 3 Point 2.3 as follows:

"Each balance group in the APG control area must be balanced at 15-minute granularity for its external (section  2.3.1) and  internal  (section  2.3.2) transactions  at gate closure  time for  each border’s day-ahead transactions.”

In order to clarify this obligation also within the general terms and conditions of APCS, a further application in point 1.4 of the general terms and conditions (terminating the contractual relationship) is added.

The change of our general conditions shall lead to a change in behaviour of the concerned trading balance groups, in order to protect balancing energy resources (provided by Austria or neighbouring countries for Austria) and to reduce the risk for the system including the joint and several liability. The physical provision of control reserves resources shall be used in compliance to their purpose.
